In a recent judgment, the Audiencia Provincial de Madrid condemns Cajamar return 30,000 euros, plus interest, to a married couple from Madrid, buyers of a house located in Campos del Rico (Murcia) in what was to be the complex known as Trampolín Hills Golf Resort. The promoter filed for bankruptcy and the buyers were unable to recover their advances or get their house.
The Court mentions in its judgment that CajaMar did not require Trampolin Hills to use a special account nor did it require the concurrence of a bank guarantee to return amounts, collaborating with said promoter, without worrying whether or not it complied with the law at that particular point. The Court indicates in its judgment that the condition of consumer of the buyers is proven, since the house would be destined to holiday use.

The sentence condemns not only the return of the amount paid (€ 30,000), but also the payment of the interest generated from the payment of that amount in 2006 and the legal costs.

For the lawyer who has taken the defense of the interests of the buyer, Magdalena Rico Palao, the platform www.reclamacionesviviendasnoentregadas.es, the sentence is a great relief for their clients, who gave for lost their life savings, to find the promoter in bankruptcy and without any possibility of recovering the amounts delivered. “We see that the courts are returning hope to many families, it’s great news,” he concludes.
